Judge Reaffirms DACA Ruling
A federal judge in Texas, Andrew Hanen, reaffirmed his previous ruling declaring the Deferred Action for Childhood Arrivals (DACA) program unlawful. The revised version of DACA was also deemed invalid, citing legal and constitutional concerns.
Limited DACA Protections Remain
While new DACA applications cannot be approved, renewals for recipients who received DACA status before July 16, 2021, may continue. The Department of Homeland Security must also publicly note the injunction.

The ruling follows legal arguments from multiple Republican-led states seeking to end DACA, claiming the program burdens state services. Hanen had earlier ruled DACA invalid due to lack of public input under administrative law.
White House Responds
The Biden administration expressed disappointment, reaffirming its commitment to defend DACA. It vowed to continue processing renewals and accepting applications despite the judge’s restrictions.
