Republicans Weigh Using 14th Amendment to Ban Mamdani From Office

House Republicans are reportedly weighing an unprecedented move to block New York City mayoral front-runner Zohran Mamdani from taking office if he wins Tuesday’s election — citing the 14th Amendment’s “insurrection clause.” The proposal, first reported by the New York Post, has sparked fierce political debate and drawn national attention just days before voters head to the polls.

The effort is being driven by the New York Young Republican Club, which argues that Mamdani’s past activism — including his “resist ICE” comments during immigration raids and support for groups critical of U.S. foreign policy — could be interpreted as giving “aid or comfort to the enemies” of the United States. They claim this meets the criteria under Section 3 of the 14th Amendment, a post–Civil War measure originally designed to bar former Confederates from holding public office.

Mamdani’s supporters dismiss the accusations as politically motivated and baseless, describing him as a progressive lawmaker focused on housing reform, public transit, and social justice — not insurrection. Legal scholars largely agree that applying Section 3 to a municipal race would face enormous constitutional hurdles, both in defining “insurrection” and in establishing jurisdiction for enforcement.

Still, the episode highlights a growing trend in American politics — the use of rarely invoked constitutional clauses to challenge opponents in court and in public opinion. Whether the effort gains any traction remains uncertain, but it underscores how deeply polarized legal and political fights have become in the nation’s biggest city.
