Melissa Gilbert appeared visibly emotional in a New Mexico courtroom as a judge ruled that her husband, Timothy Busfield, would be released ahead of trial on his own recognizance. Judge David Murphy authorized the release under strict conditions, including mandatory court appearances, supervision by pretrial services, and compliance with multiple restrictions.
Busfield, 68, must avoid firearms, alcohol, illegal drugs, contact with alleged victims and their families, and any interaction with minors. He is also barred from discussing the case with witnesses and must keep the court informed of address changes. Prosecutors had opposed his release, but the judge ruled supervised release appropriate while the case proceeds.

The state cited concerns tied to past allegations, including a claim by Claudia Christian, and questioned Busfield’s actions after an arrest warrant was issued. Busfield’s defense submitted a psychosexual evaluation that categorized him as “very low risk,” citing strong family support, steady employment, and cooperation during the assessment—an evaluation that also included input from Gilbert.
Busfield faces charges related to alleged inappropriate contact with two minors while working on a television set and has denied all allegations. If convicted, he could face significant prison time. The case remains pending, with a trial date yet to be set, as the court weighs evidence and arguments from both sides.
