His attorney argued that he had acted only from concern.
They presented the photographs, false notebook entries, and statements alleging that I had become confused.
Then Karen called Marcus to testify.
He explained how David found him at the church meal program.
He described the weekly payments.
And he told the judge how David pressured him to provide dishonest observations.
“I told him she seemed fine,” Marcus testified.
The courtroom was silent.
“He told me to find something wrong.”
The payment records supported every word.
My independent medical evaluations confirmed that I was fully capable of managing my health, property, and financial affairs.
Then Karen presented David’s communications with the developer and guardianship attorney.
The emails revealed the private payment he expected to receive after the cabin was sold.
They also showed that the sale had been discussed before David began documenting my supposed decline.
The judge dismissed the guardianship petition.
She also referred the evidence to investigators.
David later claimed he had been trying to protect our future.
But protecting our future would not have required inventing an illness.
It would not have required paying someone to follow me.
And it certainly would not have required secretly negotiating the sale of property he did not own.
Our children were devastated.
Emma initially struggled to believe that her father could plan something so calculated.
Ben remained silent for several days.

“If Mom was really ill, why did you need someone to lie about her?”
David had no answer.
The divorce was finalized several months later.
